ive moved and my landlord is refusing to refund my security deposit on the fact he claims the tank caused humidity which caused a mold bloom. We did have a problem with mold but so did our neighbors across the way. There was a toxic mold problem and the apartment complex itself was rotting with sagging floors and a stair/walkway that was detaching from the building itself. I'm wondering, if i have no possibility of winning this if i shouldnt just send the pictures to the county health department and have them shut his complex down. we were living under dangerous health conditions and this guy was a slumlord.

If you violated a term of your rental agreement to have the aquarium (needed prior approval, only under 20 gallons, etc.), you can safely assume your money is gone.

If not, take him to small claims court. Send him a written request for the deposit with delivery notification. Give him 30 days to respond and when he doesn't, file suit in your local small claims court. It's very easy to do, but bring all of your paperwork and have it well organized in a folder that you can hand to the judge (a table of contents and nicely marked labels on the various documents will be welcomed by the judge, a person you want to be happy).

Bring your own photographs of the condition of the apartment (they will be helpful to the judge determining that the place is a slum).

Whether or not you get your money back, send your photographs and a written complaint to your local housing board. If you can get them on the phone, you may be able to find someone helpful and they can be more precise as to what steps you must take. In any case, step one is: Decide what you want to have happen (the place gets condemned or cleaned up and all necessary maintenance is completed) and why (because you believe that you may have been harmed and all current residents are being harmed).

But don't make threats. Threats only cause defensive responses. If you want to make your request slightly ominous, have your very polite written request for your deposit printed on an attorney's letterhead.

the prior landlord approved it and never had a problem and then a new owner bought the place who stopped paying for any maintenance (we wound up having to do home repairs on our dime). he's the one who had a problem with it. we believe he doesnt want to pay back the security deposit since the prior landlord was the one who actually received the money.

one more thing you can do is call the department of health. and report it. they will investigate it and if they find more else where (which they will) they site the owner to fix all mold issues. if they dont comply then the building get condemend till the issue is taken care of. this will cost the owner more than what the deposit is plus he has no choice but to have to deal with the gov. believe me he will give on this, tell him if thats the case you want to call the health department to report the fact that there is mold growing in the apartment and have them give you the results of there findings. say it right though not all pist off. if not report it anyway it will give him a big head ache.

yeah and if he does give teh deposit back.. report him anyways. :P he took away from your life to deal with this little thing. also do you really want the others there to get sick?

just get the money back and report him anyways

OMG man. wtf? i was dying forever to find someone local into reef tanks and FINALLY when i move i find someone. GO FIGURE.

If the other rental had the same problem find out if they had a tank and what was the excuse he gave them.

i decided to move so i could dive all the time in warm water and see acros in the wild. well, that was 1 reason on my list of 2 pages of reasons i wrote before i considered moving here. can you believe i was paying 1175 a month for 650 sq ft of that mold infested sh%thole?

dam bro. i hope you got kissed because you sure got screwed. i pay 865 for a 2 bedroom. not sure sq feet but its good size my longboard fits on everywall even in the bedrooms, with no mold i might add.
