Hi there,
I need a bit of help understanding a process.


I received a ticket last year in NYC (however, I live and drive in NJ)for :cell phone usage, not being able to find my insurance card (since it's a year old, it's probably too late to show them that I did in fact have insurance right?).

I hadn't been paying attention and have been overall negligent regarding the issue and of course my license is now suspended pending payment/etc of the fees.

I do not have any information regarding this ticket. How can I pay it? I'd like to start driving in NYC again because I'm tired of it taking 1.5 hrs to get to Brooklyn....

I've looked around the NYC DMV website but wasn't able to figure out the process if I don't have the original ticket/complaint number.

if this ticket was written by a police officer you can not find it on the web site. you will have to go to the court(borough) that it was issued. there is most likely a bench warrant issued for you. bring cash with you as there will probably be a bail that you may have to post. when you miss a court date on a uniform traffic ticket they will suspend your license. if you are could driving with a suspended license anywhere it is a misdemeanor ( aggrivated unlicensed operator 3) so please dont drive. it will keep you out of jail

Where in the city was the ticket issued. Go to that borough's traffic court and pay the fines. Bring lots of money there will be penalties for the fines and pay them. Cell phone is 130 + surcharge for NYS which is required + penalties. Insurance is 90+ required surcharge + penalties. They will give you a receipt. Carry it with you.

If you plead not guilty. You must still appear and bring money to post the bond. I have traffic court at 8:30 today. If you have any particulars PM me with them so I can try to ask about it for you.

The ticket was in the Bronx
Unless I take off of work, the soonest I'd be able to take care of this would be...March 17th (I have a doc appt in the city) , unless I can find a DMV that is open on the weekends.

Wait, just to check: Can I be penalized for driving in NJ??? My license is only suspended in NY.

Not just yet Chief...though now I'm not sure about this whole warrant thing. I'm pretty sure I didn't receive any mail that said anything about that.

If your license is suspended your license is suspended, anywhere you drive will be suspended if in fact it is suspended- if you got a letter stating your license IS in fact suspended then its definately suspended and if you drive anywhere with that suspended license you are in fact operating a motor vehicle with a suspended license.... capish? lol

PDNYC correct me if I am wrong but I believe Im not- Said their license is only suspended in NY- Once is suspended is suspended PERIOD. Correct?

Doesnt matter what state your in if you get a letter saying its suspended pending payment its not just suspended in the state that the ticket was issued, is suspended by the state that issue you your liscense.

For driving privelages are suspended in NY but NJ may ale suspend it. If you plead guilty for the insurance violation you will be revoked for a year after the plea is accepted. The fines for the insurance will be over one thousand dollars and can exceed two thousand if the DMV wants to impose the max fine. Here is what you need to do. Go to the dmv and have them reopen the insurance by filing a reversal of revocation application. Bring a copy of any insurance paperwork for the time period that the summons was issued as they may dismiss it on spot or you may have to request a trial. Either way if you provide the information you may get lucky and get it dismissed. The cell phone summons is a fine with no points. The insurance carries no points either. But the fines are hefty as I explained.

If you have a NJ drivers license, and NY suspends your license, all they are doing is suspending your driving priveleges in NY State (that's the entire state, not just NYC, so you don't think you can pass through Westchester to get to Massachusetts or something.

NY does not have the power to suspend an out-of-state license in the license's own jurisdiction. On the other hand, if you have a NY license and NY suspends it, you're suspended everywhere.

However... because a lot of states now have reciprocity, it IS possible that NJ will suspend your NJ license based on your NY ticket... but it's highly unlikely. NJ would be the ones choosing to do it, and you'd get notice if they did. If you haven't gotten notice, they haven't done it.

You don't actually have to GO to DMV in NY to pay the ticket. You can call them and pay over the phone; just give them your NJ license plate number. I had an old NY ticket, called NY DMV, and paid right over the phone by credit card, no problem. They're actually pretty good about it, and easier to reach than our own NJ MVC.

Thats what I thought they were saying was that Jersey sent them the letter, I must have misunderstood.

Yeah, I just read the original post again & he just lives & drives in NJ; the license is suspended in NY. He'll be fine, just needs to get DMV on the phone with a credit card in hand. :D

Like I said before. Driving with a cell phone = violation. Driving with a suspended license = crime

That's not true unless they changed the law in the past year. I got a ticket for driving suspended in NY. I don't have a criminal record; I got a traffic summons for it and paid it over the phone with DMV.

Law was changed 5 years ago. It is called aggrivated unlicensed operator. First offense is auo 3rd. Auo 1st is a felony. Auo 3rd and 2nd are misdemeanors. I deal with this every day in westchester. Once again if you are caught driving with a suspended license it is a crime.
