Has anyone here made a claim with Paypal? I bought a set of lights from someone on a New England Forum and never got them. I have upgraded my dispute to a claim against this person and was wondering how long it takes for PP to make their decision.

It can take a little while, as the seller is given time to respond. Check the Paypal site as they list how long the seller has to respond before they close the case in your favor.

If you paid for the item by CC you may want to file a claim with your CC company instead. Since you didn't get the item they'll take the charge off your account right away and then the seller will have to prove you got the item.

If I remember, Paypal has a policy where a claim can only be made within a certain amount of days after the transaction.

Not to side track here, but I was in a similar situation with an MR member.
Out of generosity, I provided the user with extra time to ship. After numerous claims of "going" to send the item or refund, the user ran away with the cash and never responded again. In the end, I could not file a claim because of the period of time.

Hopefully you didn't wait to long to file a claim.

They may have gotten lost in the mail (I really think he never sent them though) so I will give him the benefit of the doubt. I just want my money back. I do find it strange that there has been no reply from him even to PP.

I did get my dispute in before the time limit and I hate to do this to someone, but I feel it's the sellers responsibility to make sure I got my items and if not to at least keep in touch with me about it. The worst part is, this person is an administrator of the site.

They will track the transaction like paypal and the postal inspectors will. If he didn't send the item and took your money a call from the FBI might set him straight.

I went through a similar transaction with an ebay auction. I sold my entire star wars toy collection to someone who claimed he sent the full amount but then only sent a MO for 50 bux. The items were worth over 1,000. He then got my number from ebay and kept leaving messages on my machine. After a call from the IFCC he called back and sent payment after apologizing quite a bit. Then he started making demands about getting the items. The IFCC helped me put a freeze on the amount in his bank account for the funds. They also contacted him in regards to the aggravated harassment charge and set him straight. They can only help matters. You need to provide them with info on the transaction etc, I can say from my experiences it was beneficial for me.

BTW, How long has it been? I ordered a refractometer from someone on ebay and she told me she mailed it out 11/30 I didn't get it until 12/28 or so it was only coming from FL
Funny thing was The same day I put a dispute in it turned up in my mail box..

I specifically asked when shipped to give me a tracking number and who the shipper was in case of a problem, even if it was legitimatley shipped, had there been a problem, I hopefully could find out where it went.

It was'nt an e-bay seller it was someone on Reefbuilders Forum, which is a New England based forum.

IFCC is the best choice. If you have tried to resolve it with the seller and you can't go to someone who can help you in an official capacity. What's the worst they can do to him? Neg feedback and a ban? They still got the $$ and you're still SOL.

Sorry to hear Psycho graphics!!! This is the reason I don't do business with unknowns. I purchased from someone on RC many years ago, he did send the pump. It wasn't working, contacted the seller, who denied the pump was no good. After I contacted paypal, and they froze his acct., he told me to send the pump back to him for a refund. I paid $15 to send it back to him, and the refund I got was $0.25. Paypal stated that he sent the item, and that was all they cared about.
Never again....

I just filed a claim with Paypal over a toy I bought on Ebay which never arrived...the seller was also dumped off Ebay. It was a fast and easy procedure....I got a response from Paypal within a week that the claim had beeen settled, and I'd get my money back in 3-5 days. However, the money was already there when I checked my account.

I got an email from paypal today and I'm getting my money back. The seller claims to have not been online since he promised to return my money. How stupid are people, I went on the Reef Builders Forum and checked his activity about every 3 days. Guess what, he was on and posting every day I went there.

If you are ever on that site and see anything for sale from Marc Smith, don't trust him, he is a liar and a snake.
