LOL Sidewinder. Actually, I started my practice in the general litigation area doing all kinds of defense work. I left litigation about 4 1/2 years ago--too demoralizing to see the types of claims that people bring just to make a buck. Now I practice Employee Benefits/ERISA/Executive Compensation for corporate clients. What a relief!

I'm totally amused at all this malarky. The court system has a long and grandiose history of being abused so that bitter people can take punitive actions against others with little or no merit.

Again, it seems that one dork LFS has stooped to further stupidity thinking that this idiotic lawsuit was not going to backfire on them. If I were involved in this case, I'd be preparing press releases for all the major media, ACLU, EFF, etc. and turning this into a circus. I'd make a few phone calls and John C. Dvorak would have me on TechTV in a few days. I'd also contact the legitimate, but close-sounding larger LFS and ask them to jump on my side to champion freedom of expression, thereby promoting their cause and noting the distinction between them and the bad guy.

IMO, it appears that the vast majority of claims in the lawsuit can easily be nullified with a simple search of messageboards such as reefs.org. If you can find even one single message criticizing the LFS which is dated prior to the defendant's "infraction", then the defendant's statement is proven true - end of story.

The only other thing that disturbs me is this solicitation for a "legal defense fund". The only winners in these kinds of lawsuits are the lawyers and I don't want to encourage them to fan the flame of this two-bit personality conflict by giving them one red penny. Everyone has a lawyer friend who can file something, then they show up with some computer printouts and it's done.

Plain and simple. Petwarehouse should fund the money for defendants and this alone will boost their business. If this case make it to a full court, and Petwarehouse is funding the defense. It will be big news. Big news will create big business for Petwarehouse. First, they get to defend their name. Second, they get introduced to the big public.

I went to do business with them ( I am not staiting a name because I want to dump all my spare cash into my tank not a legal fund) they were recomended highly. I check out the web site, avalability was good, prices were good, guarentee was good. Gave the fish room a cal, placed my order. Over half the items were out of stock. Not a problem. When the ordering was done I wanted to know what the damage was, well all of the internet prices were wrong. When I staed directly from the site the "gentleman" on the other end stated that they were incorrect. The differance on the entire order was about 500.00. Not peanuts. When I stated that I would like the items for the advertised price I received an earfull of foul language. I have reported them to the BBB for false advertising and whenever I see or hear their name I have no problem voicing MHO. I say boycott and put this type of person out of business.
