NEED ADVICE Aquarium For You out of bizz

I need some advice, A friend of mine just called me and told me that Aquarium for you is going out of bizz, meanwhile they kept taking my friends deposits on a fairly expensive setup and now that my friend is towards the end of the payments, they send him an email stating that there going out bizz and my friend my be screwed and may have to take a large loss. what advice can we give him to try and regain his large deposit

Does he have any kind of contract? Also, how is the business organized? If it is a Sole Prop or a partnership you can go after the owner(s) personal assets. If it is a corp he might screwed......legally. Then he might have to try to get his money mob style.

If your friend deposit is plenty, the best suggestion seek legal advice. But, if was me Me...I go into his store and tied the MF, and take what belongs to me! Then stuff him in a tank!

If it's a Visa/MC debit there is buyer protection. Tell him to get on the phone with the Bank and explain the situation.

I found out about this last week and the same situation occurred to one of our customers. They ordered the tank and he told them to go after the credit card company. I forget his name, but he wanted to get out of the business and he is shutting down his facility, but one of his employees is opening up a few doors down from where they were. I was never very impressed with his tanks or his business ethics but one of the partners at the store is in love with him for whatever reason. In my opinion, there are far better places you can get a tank built.

Thank goodness I never wound up giving them a deposit for my tank and they were hounding me for one. They wanted $5,000 deposit for my
96x42x36 tank. I kept telling them its way too early for a deposit and I was having them build it on-site. I am still 11 months away from moving in to the home so I have a few months yet. now I need to find another sourse to order and build this at my house.

The problem with disputing charges, as many people have found, is that they PAID for the deposit more 60+ days ago in which case they are basically SOL from most credit card companies or banks. Its going to be tough to get any $ out of them.

IMO - Get a lawyer. You may lose some money in legal fees, but at least he can recoup some of the loss. Some is better than none

Dispute with MC or Visa. I just did this for a service that was never received and my account was credited.

IMHO your friend should try going there personally and getting back as much of his deposit in the form of whatever materials AFY has on hand, before they file for bankrupcy protection.

Just called them and the answering machine picked up and said they are having problems with their phone system. I am waiting to hear back from them.....

I really dont think this is true. From when I handled these things at work I found out that most credit card companies will consider things up to 18 months and I believe AMEX gives up to 3 years. Its just harder if its longer.

People had the same problem with Levitz now that thety went under. Those who paid cash deposits for furniture were SOL but those who made deposits on CC's were able to do a chargeback. I dont know how it works with debit cards.

Also File With Bbb, Notthat It Will Make Much Difference Since They Will No Longer Be A Business, And A Debit Card Is Usually Endorced By Visa Or Mc. As Well As You Can File A Theft By Deception Case With The Police, Especially If Could Prove They Knew They Were Going Under When They Took The Deposit
